CHIP 3.2: Technical changes for classifying, packaging and labelling chemicals

Relevant to
Chemical manufacturers, suppliers and users in England, Wales and Scotland. Those businesses that make, sell, store or transport dangerous chemical substances or preparations for retail or wholesale distribution.

Took effect on
1 October 2008

From 1 October 2008, new rules will amend the Chemicals (Hazard Information and Packaging for Supply) Regulations 2002 (CHIP).

They set in place changes to three technical annexes as required by EC Directive 2006/8/EC - otherwise known as the 2nd Adaptation to Technical Progress of the Dangerous Preparations Directive (the 2nd ATP).

The new rules introduce certain adjustments – rather than any major change requirement. They will affect:

  • the procedures you use when classifying and labelling chemical preparations containing carcinogens, mutagens or other substances that are considered to be toxic for reproduction
  • the generic concentration limits you must use when evaluating the risks to aquatic environments
  • how you classify and label preparations containing ozone depleting substances

This means that if you supply dangerous chemical substances or preparations, you may be required to:

  • re-classify some of them
  • change the product labels for certain chemicals to use revised specific warning phrases
  • change information on any safety data sheets you provide

Also, if you store large quantities of newly re-classified chemicals on site at any one time, you must check whether they will come under and thus need to comply with other regulations that:

  • control hazardous substances - ie the Control of Major Accidents Hazards regulations (COMAH)
  • trigger specific workplace controls for a carcinogen - ie the Control of Substances Hazardous to Health regulations (COSHH)
